VIINK END USER LICENCE AGREEMENT Version 3.0 — Effective date: 24 July 2026 This End User Licence Agreement (the “Agreement”) governs your use of ViInk, distributed by Marc Alvarez Lopez trading as Maloz Films (“Maloz Films”). By installing, activating or using ViInk, you accept this Agreement. If you do not accept it, do not install or use ViInk. 1. VIINK LICENCE Maloz Films grants you a limited, personal and non-exclusive licence to install and use ViInk according to the plan purchased. The licence may not be transferred unless applicable law expressly grants a right of transfer or resale. Individual licences may be activated on up to two computers used by the same person. Business, educational or multi-user licences are additionally governed by their specific quotation or agreement. 2. TRIAL AND ACTIVATION The free trial may be used for the period displayed in the application. Paid use requires a valid serial number and may require periodic contact with the licence server. You may not deliberately bypass activation, share serial numbers beyond the authorised devices or use credentials obtained fraudulently. 3. SUBSCRIPTIONS, CANCELLATION, WITHDRAWAL AND UPDATES The price, applicable taxes, billing interval and renewal conditions are displayed before purchase. Subscriptions renew until cancelled. You may cancel to prevent future renewals using the mechanisms offered at purchase or by support, without affecting any statutory right to an online cancellation facility. Where a distance purchase carries a statutory withdrawal right, you retain that right for the legally required period. For digital content supplied immediately, that right is lost only when every legal condition has been met, including your prior express consent to begin supply and your express acknowledgement that the withdrawal right will be lost. Installing, activating or using ViInk does not by itself replace that specific consent. For purchases made on the ViInk website, those confirmations are requested separately, are not pre-selected and are linked to the purchase email and checkout session. Contract confirmation is sent by email. Where applicable, you may exercise withdrawal online at https://malozfilms.com/viink/legal/withdrawal.html and will receive a durable acknowledgement containing the declaration, date and time. Cancellation prevents future renewals but does not remove mandatory refund, withdrawal or warranty rights. Maloz Films may provide fixes and updates. A lifetime licence permits indefinite use of the version purchased; it does not guarantee that every future major version will be free. Updates required by a statutory guarantee or applicable law are not limited by this clause. 4. OWNERSHIP AND PERMITTED USE ViInk and its proprietary components are owned by Maloz Films or its licensors. You may create, edit and export your own content or content you are authorised to use. You retain all rights in your videos, images, drawings and projects and are responsible for having the required rights to processed material. You may not redistribute, resell, rent or present ViInk's proprietary components as your own product, or remove their ownership notices, except where applicable law provides otherwise. Nothing in this Agreement limits rights expressly granted by applicable law or a free-software licence, including rights of study, modification, interoperability, reverse engineering, transfer or resale where those rights cannot be excluded by contract. 5. THIRD-PARTY SOFTWARE — FFMPEG ViInk distributes and invokes FFmpeg as a separate program for editing proxies, audio processing and video export. The bundled build, n8.1.2-30-g45f1910444-20260722, contains GPL components including libx264 and libx265 and is distributed under the GNU General Public License version 3 or later. FFmpeg is not owned by Maloz Films and is not subject to the restrictions that apply to ViInk's proprietary components. The licence, version, hash, corresponding source code and build scripts are available at: https://malozfilms.com/viink/legal/third-party.html Copies of LICENSE.txt, FFMPEG_BUILD_INFO.txt and THIRD_PARTY_NOTICES.txt are also installed in ViInk's ffmpeg folder. If terms conflict, FFmpeg's GPL controls for FFmpeg and its components. 6. DATA AND PRIVACY To start a trial, activate or validate a licence and check for updates, ViInk may send the serial number, a pseudonymous device identifier, application version, validation dates and results, and minimal technical request data to Maloz Films' server. The server may record the IP address for security, fraud prevention and service operation. This processing is carried out to perform the contract, manage activations and support, comply with legal obligations and protect the service. Data is retained while needed for the licence and for applicable legal, accounting, security and claims periods. Payments are processed by Stripe under Stripe's own terms and privacy policy. ViInk does not claim rights in your projects and does not need to upload your videos for local editing. You may request access, correction, deletion, restriction or objection and lodge a complaint with the competent data protection authority. STATUTORY GUARANTEES If you are a consumer, you retain at no cost every right under the statutory guarantee of conformity applicable to digital content and services and, where applicable, the guarantee against hidden defects. These rights may include bringing ViInk into conformity, a price reduction, or termination and refund where the legal conditions are met. Maloz Films is responsible as seller under the conditions and for the periods prescribed by applicable law. 8. OPERATION, LIABILITY AND BACKUPS ViInk is supplied with the level of care reasonably expected from a software product, but it is not guaranteed to be uninterrupted or error-free on every combination of hardware, codecs and drivers. Keep backups of original media and important projects. To the extent permitted by law, Maloz Films is not liable for indirect loss, lost profits or lost data that is not a direct result of a breach attributable to Maloz Films. Nothing in this Agreement excludes or limits mandatory consumer rights, fraud, wilful misconduct, gross negligence, personal injury or any liability that cannot legally be excluded. 9. TERMINATION You may stop using and uninstall ViInk at any time. Maloz Films may proportionately suspend a licence obtained fraudulently, shared beyond its limits or used in a serious breach of this Agreement. Where reasonably possible, the reason will be provided and an error may be corrected, without affecting mandatory user rights. 10. GOVERNING LAW AND COMPLAINTS This Agreement is governed by French and European Union law, without depriving consumers of mandatory protection in their country of residence. Disputes will be submitted to the courts competent under applicable law. Before referring a consumer dispute to mediation, send a written complaint to viink.support@malozfilms.com so that Maloz Films can try to resolve it directly.
